Is The Porn Debate Irking India Again?

Porn Ban

The Supreme Court’s decision on Friday, to call for a ban on child pornography, was an imminent move. The apex court directed the Centre to block all child-porn websites and desist from giving excuses of technical difficulty.

Expressing distress over the presence of multiple child-porn websites, an SC bench said, “Innocent children cannot be made prey to these kind of painful situations, and a nation, by no means, can afford to carry any kind of experiment with its children in the name of liberty and freedom of expression”.

The bench also mandated that people will not be allowed to watch porn in public places and those caught doing so, will be booked for obscenity.

However, months after deliberating over a blanket ban on numerous porn sites and deciding it was not plausible, the apex court took a U-turn. On Saturday, the SC once again went ahead to explore the possibility of banning “blue films” on the internet. It ordered the Centre to find “ways and means” to block pornographic sites.

The Centre’s reluctance to curb one’s right to privacy was not considered by the SC, which asked it to carry out the “difficult but not impossible” task.

While the decision to ban all child-pornography websites is praiseworthy, there is not a valid need to ban porn as a whole. A sensible human being is unlikely to get influenced by whatever he sees. Porn is but a stimulating act and to term it as “obscene” is unfair. An impressionable person may get swayed by anything, but that does not mean the country can impose incessant bans on everything.

Supreme Court’s argument linking rapes to porn is trite and repetitive. Instead of considering banning porn, the court may perhaps think on the lines of interdicting rapes and rapists. Mollifying porn and suppressing desires, will only lead to more unrest in the society. Crimes are caused by criminals; only a rapist will rape and only a voyeur will indulge in voyeuristic activities.
